In Connecticut, a burglary can only be classified as a burglary when an individual unlawfully enters a building in hopes to commit another crime inside the premises. There are many factors that can help distinguish a burglary from home invasion and from trespassing.

How Is a Burglary Bail Bond Determined?

In order to understand what factors play into how a burglary bail bond is determined, the crime must first be examined. A judge will pay extra attention to the following factors about the burglary:

The suspect’s intent. What was this individual attempting to do when they broke into the building/home? How severe is this crime? The more violent, the higher the bail. The more serious, the higher the bail. For example, a scenario where it seems that a suspect has broken into a home and attempted to hold the residents hostage will likely have a higher bail than thieves who broke into a home to steal things while the residents were on vacation. This means that both the intent and the other crimes committed while inside are important in determining bail.

The place that the burglary occurred. Was it a home with residents in it? Was it an office building at night, while nobody was in the office?

The tools used. In Connecticut, it is a crime to make, alter, or possess any tools that a person intends to use in a crime. If tools were used and the intent was to harm with these tools, this can also increase bail.

The factors above describe a few different circumstances that can increase bail. However, these are burglary specific. Below outlines some other factors that can also increase/decrease bail, no matter what crime was committed:

The age of the defendant. If the defendant is under 18 years old, they will likely be tried as a minor. This usually means a decreased bail amount compared to if that suspect was an adult. However, in some cases the crime is so extreme that a judge will decide that the suspect should actually be tried as an adult. 

Past criminal record. If this suspect has committed a similar crime in the past, or if the suspect has any other past infractions, bail will be increased. This is because the more crimes that this individual commits, the more likely it is that they will continue to commit crimes in the future. 

Previous trials. Has this individual skipped out on trial before? If so, bail will be increased. 

The individual’s community standing. Does this person hold positive ties to the community?
